Factual basis:
On 14/15 July 1995, Stanišić was commanding and supervising the members of the 6th Battalion, together with other units of the Army of RS, taking over and guarding several hundreds of Bosniak men who were brought by buses and trucks from the UN Safe area Srebrenica to Petkovci whom he knew would be executed after temporary detention in Nova škola (New School). After over 700 hundred captured men were executed at Crvena brana, Stanišić, with the aim to hide the committed crime, engaged the members of the 6th Battalion to hide the bodies together with the members of the Engineer Company of the Zvornik Brigade in a mass unmarked grave at Crvena brana with an excavator and loader and to remove the traces of blood and the bodies of the killed detainees around Nova škola and other places in Petkovci and drive them to Crvena brana and bury them in an unmarked grave.
